Waiver Release & Indemnity
(PLEASE READ CAREFULLY, THIS IS A LEGAL DOCUMENT)

WAIVER

This form must be completed by the volunteer under 18 years of age with their parent/guardian prior to starting any volunteer activity.

THIS RELEASE WAIVER AND INDEMNITY is in favour of Habitat for Humanity Halton Mississauga Inc. , an Ontario non-profit corporation, Habitat for Humanity Canada, a federal non-profit corporation, and Habitat for Humanity International Inc., a non-profit corporation (collectively “Habitat Halton Mississauga”) and all of their respective directors, officers, employees, contractors, members, agents and donors; all title house donors, all sponsors, all media partners, all contributors of services, food, beverages, shelter and transportation, and each of their respective directors, officers, employees, contractors, members and agents; all registered owners of properties at which salvage operations are conducted and their directors, officers, employees, contractors, members and agents where such registered owner is a corporate entity; any owner/operator of any trade show or public event at which Habitat London may be participating and the owner/operator’s directors, officers, employees, contractors, members and agents; and all partner families.

I wish to participate in any of Habitat Halton Mississauga’s program activities located at any of its office, ReStore, warehouse, salvage or build locations or at a location of any trade show or public event in which Habitat Halton Mississauga is participating. I understand that such activities may include lifting, climbing, use of tools and other physical activities. I testify that I have had safety training at HFHH.

In consideration of my desiring to participate in Habitat Halton Mississauga’s program activities:

1. WAIVER AND RELEASE: I, my heirs, executors, estate trustees with or without a Will, administrators, successors and assigns do hereby release and forever discharge and hold harmless Habitat Halton Mississauga and their respective directors, officers, employees, contractors, members, agents and donors; all title house donors, all sponsors, all media partners, all contributors of services, food, beverages, shelter and transportation, and each of their respective directors, officers, employees, contractors, members and agents; all registered owners of properties at which salvage operations are conducted and their directors, officers, employees, contractors, members and agents, where such registered owner is a corporate entity; any owner/operator of any trade show or public event at which Habitat Halton Mississauga may be participating and the owner/operator’s directors, officers, employees, contractors, members and agents; and all partner families, from any claims, demands, damages both direct and indirect, costs, expenses, actions and causes of actions, whether in law or equity, in respect of death, injury, loss or damage to my person or property, howsoever caused arising or to arise by reason of my participation in or attendance at any of Habitat Halton Mississauga’s office, ReStore, warehouse, salvage or build locations or at a location of any trade show or public event at which Habitat Halton Mississauga is participating.

2. MEDICAL TREATMENT: I, my heirs, executors, estate trustees with or without a Will, administrators, successors and assigns do hereby release, waive and forever discharge Habitat Halton Mississauga and their respective directors, officers, employees, contractors, members, agents; all title house donors, all sponsors, all media partners, all contributors of services, food, beverages, shelter and transportation, and each of their respective directors, officers, employees, contractors, members and agents; all registered owners of properties at which salvage operations are conducted and their directors, officers, employees, contractors, members and agents where such registered owner is a corporate entity; any owner/operator of any trade show or public event at which Habitat Halton Mississauga may be participating and its directors, officers, employees, contractors, members and agents; and all partner families from any claim, demands, damages both direct and indirect, costs, expenses, actions and causes of actions, whether in law or equity, in respect of death, injury, loss or damage to my person or property, howsoever caused arising or to arise on account of any first aid, treatment, or other medical service rendered in connection with my participation in or attendance at any of Habitat Halton Mississauga’s office, ReStore, warehouse, salvage or build locations or at a location of any trade show or public event at which Habitat Halton Mississauga is participating. I understand that I am responsible for securing all appropriate medical insurance coverage. I acknowledge and accept that any such medical services as may be available may be performed by volunteers or outside agencies and that Habitat Halton Mississauga has no control or responsibility for the quality of any medical attention that may be provided.

3. ASSUMPTION OF RISK: I understand that volunteer work may include activities that may be hazardous and that Habitat Halton Mississauga’s goods and equipment may be donated to Habitat Halton Mississauga and beyond the control of Habitat Halton Mississauga. As such, Habitat Halton Mississauga cannot and will not assume any liability for the condition of such goods and equipment or of the nature of the activity. I understand that Habitat Halton Mississauga retains the right to limit or prohibit my participation in any activities of Habitat Halton Mississauga if Habitat Halton Mississauga determines that such participation will not be in the best interests of either it or me. I understand that I will be responsible for the payment of any expenses incurred as a result of application of this section.

4. PHOTOGRAPHIC RELEASES: I do hereby grant and convey to Habitat Halton Mississauga all rights, title and interest in any and all photographic images, whether electronic or otherwise, and in any video or audio recordings made by Habitat Halton Mississauga or its media partners, including, but not limited to, any royalties, proceeds, or other benefits derived from such photographic images . I further understand that Habitat Halton Mississauga may use, or authorize use of such images and recordings for broadcasting and in fundraising and other corporate materials and I consent to such use without any royalty or payment to me.

5. OTHER: I expressly agree that this Release is intended to be as broad and inclusive as permitted by the laws of the Province of Ontario, and that this Release shall be governed by and be interpreted in accordance with the laws of the Province of Ontario. I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such a clause or provision shall not otherwise affect the remaining provisions of this Release that shall continue to be enforceable.

6. HABITAT FOR HUMANITY HALTON MISSISSAUGA PRIVACY OF INFORMATION STATEMENT: We do not sell, trade, rent or in any way distribute your personal information. We use your information to keep you periodically informed of our activities including programs, funding needs, special events, and opportunities to volunteer or to donate. If you do not wish us to contact you, please notify us by email at habitathalton@habitathm.ca, by telephone, or by mail, with your full name and address. We will remove your name from our confidential list within 30 days of receipt. Otherwise by signing this Release you are consenting to the use of your personal information for the above-noted purposes. Our Privacy Policy can be viewed at www.habitathm.ca

CODE OF CONDUCT

Purpose: Our goal is to work together to achieve Habitat for Humanity Halton-Mississauga’s mission by creating an environment that supports honesty, integrity, confidentiality, diversity and equity towards fellow volunteers and staff. We understand and recognize that people work best when they know what is expected of them and, in turn, expect volunteers to follow the code of conduct that will protect the interests and safety of all Habitat for Humanity Halton-Mississauga staff, volunteers, and stakeholders.

Policy Statement: Habitat for Humanity Halton-Mississauga  believes in fair and equal treatment of all volunteers.  To this end,  every volunteer  participates with mutual respect of other volunteers, staff, and stakeholders.

All Habitat for Humanity Halton-Mississauga volunteers are required to adhere to the  policies and procedures regarding volunteer code of conduct including, but not limited to:

  • Safety

  • Prohibited Substances

  • Confidentiality

  • Communication

  • Publication

  • Gossip

  • Diversity and Equity

  • Workplace Violence

  • Commitment

  • Teamwork

  • Trust

As a Habitat for Humanity Halton-Mississauga Volunteer I will:

Safety

  • Never work while ill or fatigued or under the influence of prescription/over the counter medication that may affect my ability to work safely, including working while under the influence of marijuana or being in possession of marijuana on site

  • Participate in all mandatory safety training programs

  • Recognize that training is required for my role, and periodic supplemental training may be necessary

  • Act, ensure, and promote safe and healthy work practices are followed and are the top priority at all times

  • Follow direction of supervisor(s) and clarify task(s) and safety procedures before starting any new task; and implement all procedures to the best of my abilities

  • Only complete work designated to me by my direct supervisor

  • Only use equipment or machinery that requires certification and/or specialized training by law to operate if I have current certification and with express Habitat for Humanity Halton-Mississauga staff direction

  • Respect and use all equipment and product in the way in which it was intended

  • Follow the laws of Working At Heights and not work at any height exceeding 10’ without proper certification and safety harnessing equipment

  • Report all injuries, illnesses,  safety concerns (behavioural or structural), accidents and near misses immediately to my supervisor

  • Wear all mandatory personal safety equipment and will check with my supervisor of requirements before starting a new task

  • Not use cell phones in the ReStore or on construction sites, other than in designated break areas

Prohibited Substances

  • Recognize that smoking in Habitat for Humanity Halton-Mississauga’s buildings and on build sites are strictly prohibited, and must be at least 9 metres (30 feet) from any entrance

  • Understand that volunteering under the influence of alcohol, recreational marijuana and/or illegal drugs or possessing these items while on the premises are grounds for immediate dismissal

  • Understand that the possession of dangerous or unauthorized materials, such as explosives or firearms, is strictly prohibited in Habitat for Humanity Halton-Mississauga’s buildings and on build sites and is grounds for immediate dismissal

Confidentiality

  • Pledge to keep confidential private information of staff, fellow volunteers, corporate partners, board of directors, partner families, and other stakeholders

  • Promise not to disclose affiliate issues, operations or information on organizations with whom we are associated

  • Understand that the removal, unauthorized sharing and/or altering of confidential records without permission could be considered theft or fraud, and grounds for dismissal

Communication

  • Habitat for Humanity Halton-Mississauga ensures that clear communication is given and understood between both the volunteer and the supervisor. I will:

  • Acknowledge that speaking with any form of the media (television, radio or print) is prohibited without prior permission by the CEO or Communications Coordinator

  • Accept and respect the supervisor’s instructions, comments, and feedback

  • Provide positive language and feedback, and implement effective listening with Habitat for Humanity Halton-Mississauga staff, volunteers, and stakeholders to maintain a respectful work environment and positive experience which allows individual learning, growth and personal achievement

  • Report communication concerns or issues immediately to my direct supervisor (e.g. negative/threatening, non-inclusive and/or discriminatory language)

Gossip

Habitat for Humanity Halton-Mississauga has no tolerance for gossip. Participating in or instigating gossip about fellow volunteers, staff, corporate partners, board of directors, partner families, and other stakeholders and is grounds for disciplinary action, up to and including dismissal.

Gossip is defined as:

  • Talking about a person or person’s personal life when they are not present

  • Negative and unwelcome comments/conversation/rumours commenting on or criticizing another person or persons

  • Repeating information that can injure a person’s credibility or reputation

  • Repeating information shared with you in confidence without that person’s permission or knowledge

  • Gossip will be considered a form of harassment

Publication

  • Understand that the sharing or displaying of inappropriate or offensive images, videos, or audio is not permitted and grounds for disciplinary action, up to and including dismissal.

  • Understand the need for publication bans to protect young persons of the harmful effects of communicating or making accessible information to the general public through print, radio, television or electronic means including social media such as Facebook page, Twitter, Instagram, LinkedIn and all other social media tools that may become available over time

  • Refrain from posting any photos or videos of any volunteer, student participant, and/or member of a partner family that is under the legal age of 18 years of age, on Habitat for Humanity Halton-Mississauga or personal social media platforms and websites (including content and comments)

Diversity and Equity

Respect each other and not discriminate based upon:

  • Age

  • Ancestry, colour, race

  • Citizenship

  • Ethnic origin

  • Place of origin

  • Disability

  • Family status

  • A conviction for which a pardon has been granted or record suspended

  • Marital status (including single status)

  • Gender identity, gender expression

  • Sex (including pregnancy and breastfeeding)

  • Sexual orientation

  • Religion

  • Genetic characteristics

Commitment

Understand the importance of the volunteer work that I do at Habitat for Humanity Halton-Mississauga in fulfilling mission and agree to fulfill all assigned work and attend all registered shifts;  if unable to fulfill, I must contact my supervisor with as much notice as possible

Teamwork

  • Help and support others in achieving and maintaining the core values and mission of the affiliate while protecting the brand

  • Share the workload in a fair manner with other volunteers to restrict and prevent work related stresses, fatigue, or injury

  • Work collaboratively through recognizing the strengths in each other’s diverse skill levels and varied abilities

Trust

  • Accept that submitting any contact or personal information that is fraudulent is prohibited and grounds for immediate dismissal

  • Accept that serious violations of municipal, provincial or federal laws (including criminal charges and/or convictions) must be disclosed to Habitat for Humanity Halton-Mississauga at time of application or promptly at time of criminal charge/conviction

Workplace Violence & Harassment

I realize verbal or physical fighting or threatening of violence in the workplace is not tolerated, condoned, or ignored at Habitat for Humanity Halton-Mississauga and grounds for immediate dismissal. I will not:

  • Use inappropriate language which could be offensive against or towards volunteers, staff, or stakeholders

  • Leave threatening notes against or towards volunteers, staff, or stakeholders

  • Wield a weapon at work

  • Hit or threaten to hit volunteers, staff, or stakeholders with or without an object

  • Inflict sexual violence towards volunteers, staff, or stakeholders

  • Kick an object that a person is standing on (i.e. a ladder)

  • Try to run down a person using a motorized vehicle or equipment

  • Bully, victimize, or use demeaning humour or sexist comments towards volunteers, staff, or stakeholders
